These Terms of Use ("Terms") govern your use of our mobile application, Himmin, and its various versions ("App"), together referred to as the "Platform," made available by Supergram Tech Private Limited ("STPL," "Company," "we," "us," "our"), a private company incorporated under the laws of India, with its registered office at Koramangala 4-B Block, 5th Block, Koramangala, Bengaluru, Karnataka 560095. "You" and "your" refer to anyone using the Platform.

Our services and these Terms are designed to comply with the Indian Penal Code, 1860, and the Information Technology Act, 2000, including any amendments and rules made under them. By using the Platform, you accept and agree to these Terms. We don't claim compliance with the laws of any country other than India — if you're accessing our Services from elsewhere, please make sure you're permitted to do so under your local laws.

Using Himmin means following certain rules, which are laid out in this document along with any linked policies. Please read them carefully. By using the Platform, you're agreeing to these Terms, and if you're using it from outside India, you're responsible for complying with your local laws as well.

Changes to Terms and Services

Himmin is a fast-evolving platform, and we may change the services we offer at our discretion — including temporarily or permanently discontinuing certain features.

We may add or remove functionality without prior notice. That said, if any change requires your consent, we'll be sure to ask for it. We'd encourage you to check this page periodically to stay up to date on the latest changes.

Our Services

We provide you with our Services, covering all products, features, applications, and technologies offered through the Himmin platform.

Himmin lets you create, upload, and share short-form videos, including any sound recordings, musical works, or ambient audio embedded within those videos ("User Content").

When you publish User Content, you retain whatever ownership rights you had in it originally. However, by posting it, you grant us a license to use it, and you grant other users the right to share or communicate that content for limited, private, non-commercial purposes only.

All User Content is treated as non-confidential. Don't post anything you consider confidential, belonging to someone else, or in violation of applicable law.

By submitting User Content, you confirm that you own it, or have obtained all necessary rights, permissions, or authorisation from the owner to include it in your video, submit it to Himmin, or share it through the Platform to third parties.

If you only hold rights to a sound recording used in your video — but not the underlying musical composition — you must not upload it unless you've secured the necessary permissions for both.

You grant us a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute your videos. This is solely to operate, develop, promote, and improve Himmin, and to build new features. You also grant us a perpetual license to create derivative works from your videos and to promote, broadcast, syndicate, and publicly display them across any current or future media or platform.

Where relevant, by appearing in or creating a video, you also grant us an unrestricted, worldwide, perpetual license to use your name, likeness, and voice as they appear in that video — including for commercial or sponsored content. This means you won't be entitled to compensation if your video or likeness is used for our marketing, advertising, or product improvement.

While not obligated to, we may access, review, screen, or remove your videos at any time — whether to operate the Platform, address a Terms violation, or comply with law. That said, you remain solely responsible for anything you create or upload to Himmin.

You also acknowledge that we may generate revenue, goodwill, or business value through your use of Himmin — including via advertising, sponsorships, or usage data — and unless we specifically agree otherwise, you won't be entitled to a share of that value.

Similarly, you have no right to income or compensation from videos you publish, or from any music, sound recordings, or audio made available through the Platform, including in your own videos — unless we've specifically agreed to this separately.

If you're a composer or songwriter affiliated with a performing rights organisation, you're responsible for notifying them of the royalty-free license you've granted us through your videos, and for meeting any reporting obligations they require. If you've assigned your rights to a music publisher, you'll need their consent before granting us these licenses — or have them agree to these Terms directly.

Writing a song doesn't automatically give you the right to license it to us this way. If you're a recording artist under a label contract, you're responsible for making sure your use of Himmin complies with your obligations to that label — including for any new videos you create that may be claimed by your label.

We use the information available to us to study and improve Himmin, and may collaborate with third parties on research aimed at making the Platform better and supporting our community.

Who May Use Our Services

Himmin helps you connect with friends and share short-form videos in your preferred regional language. We personalize your feed based on your interests, showing you videos and suggested content tailored to you ("Services").

You may use our Services only if you're capable of entering into a binding agreement with us and are legally permitted to use them. If you're accepting these Terms on behalf of a company or other legal entity, you confirm you have the authority to bind that entity — in which case "you" and "your" refers to that entity.

Please make sure you're permitted to use our Services under applicable law.

How to Use Our Services

To use Himmin, simply download and run the app on your mobile phone.

You can register using your mobile number or through third-party services like your Apple ID or Google ID. We may add other registration options over time. You can verify your identity via a One-Time Password (OTP) sent to your phone by SMS.

You can also download content available on the Platform and share it across other social media platforms.

To provide our Services, we need access to certain features on your mobile device.

Himmin Creators

Select creators on Himmin — our partner creators — may be identified with a distinct badge or border on their profile. We may enter into content licensing or marketing arrangements with these creators.

Compliance Requirements

Publishers of news and current affairs content on Himmin are required to share their account details with the Ministry of Information and Broadcasting, in accordance with applicable regulations.

Safety

Our goal is to build a positive, inclusive community and a great experience for everyone on Himmin. To that end, you agree that you will not:

Use the Services for any fraudulent, misleading, illegal, or prohibited purpose.
Use bots, scrapers, crawlers, or other automated tools to access the Services or extract other users' information.
Build or use third-party applications that interact with our Services or other users' content without our written consent.
Interfere with, disrupt, or negatively affect other users' experience, or damage, overburden, or impair the Services.
Post content that infringes on any third party's intellectual property rights.
Impersonate another person or entity while using our Services.
Use or attempt to use another user's account, username, or password without permission.
Ask another user for their login credentials.
Post content that could be harmful to minors — see our Content and Community Guidelines for details.
Post or link to pornography, graphic violence, threats, hate speech, or incitement to violence.
Upload viruses, malware, or anything that compromises the security of our Services.
Attempt to bypass our content-filtering systems or access parts of the Services you're not authorized to use.
Probe, scan, or test the vulnerability of our systems or networks.
Post content that threatens India's unity, integrity, defense, security, or sovereignty; harms friendly relations with other countries; disturbs public order; incites a cognizable offense; obstructs investigation of any offense; or insults another nation.
Encourage or promote any activity that violates these Terms.
Attempt to bypass any feature, policy, or measure we've put in place — for example, trying to get around an account suspension.

Privacy Policy

Our Privacy Policy explains how we collect, use, process, share, and store your information. It also outlines your rights under law and how you can control the data you share with us.

As mentioned there, Himmin may also use third-party embeds and services. These are governed by the respective third party's own policies, and by using them, you agree to be bound by their terms of service.

Your Commitments

Building a safe, secure platform for a diverse community takes effort from everyone. In return for our commitment to providing you great Services, we ask that you make some commitments to us.

You alone are responsible for the consequences of your actions on Himmin, including any violation of these Terms. By using our Services, you agree to the following:

a. No False Information

You will not misrepresent yourself as another person or as a representative of someone else while using Himmin.

We may disable or suspend your account, or take other appropriate action, if you provide us with false or incorrect information.

b. Device Security

We've put security measures in place to protect the Platform, but no system is completely immune to hacking or malware. It's your responsibility to keep proper antivirus and anti-malware protection on your mobile device.

While we do our best to secure your experience on Himmin, we can't anticipate every possible attack. Please make sure your device isn't tampered with or misused in any way.

c. Content Removal and Account Termination

Your use of Himmin is governed by our Content and Community Guidelines. If other users report your content for violating these guidelines, we may remove it. Repeated or serious violations may lead to your account being terminated and blocked from re-registering. If you'd like to appeal a content removal, you can write to us at arjun@himmin.in.

We reserve the right to remove any content that violates our Content and Community Guidelines.

d. No Unlawful or Illegal Use of the Platform

Himmin is built to support diverse languages, cultures, and types of content, and we use tagging systems to classify content accordingly. You're responsible for accurately tagging the content you share.

You must not use Himmin to share content that is obscene, pornographic, harmful to minors, discriminatory, promotes hate speech, incites violence or hatred against any person, or otherwise violates Indian law. We reserve the right to remove such content — see our Content and Community Guidelines for more detail.

We may also share your information with law enforcement where we have a good-faith belief it's necessary to comply with legal obligations or government requests, or to protect the rights, safety, or property of Himmin, our users, or the public — including to address fraud, security, or safety concerns. That said, we aren't responsible for actions taken by other users or third parties through their use of the Platform.

Himmin is meant to be a space for great social experiences — please don't share anything illegal or harmful to the well-being of our community.

e. Content Rights and Liabilities

We believe strongly in freedom of expression and let you share videos freely on Himmin. We don't claim ownership over any content you share — the rights remain entirely yours.

You must not use Himmin to infringe on our intellectual property or anyone else's; doing so violates our Content and Community Guidelines and may result in removal. That said, any content we create ourselves remains our intellectual property.

By posting or uploading content, you grant us (and our Group and Affiliates) a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, run, copy, display, translate, or create derivative works from your content — consistent with your privacy settings — for purposes like operating, improving, or promoting our Services, or featuring your content elsewhere across our platforms.

You can delete your content or account at any time, and it may also be deleted per our data retention policies — which removes it from all versions of the app. However, content already shared by others may continue to appear even after deletion. We may also retain your content for a limited period after account deletion, in case you choose to reinstate your account. You're solely responsible for the content you post. We don't endorse, and aren't liable for, any content shared through Himmin or the consequences of sharing it. Our logo or trademark appearing near your content doesn't mean we endorse or sponsor it. We're also not responsible for any transactions you enter into with other users or advertisers on the Platform.

You retain full ownership and responsibility for what you share. We'll never claim intellectual property rights over your content — but we do hold a permanent, cost-free license to use it as described above.

f. Intermediary Status and No Liability

We qualify as an intermediary under the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms are published in accordance with Rule 3(1) of those Rules, which require us to publish our rules, Privacy Policy, and Terms of Use. Our role is limited to providing a platform where users can upload, share, and display content created by themselves or others.

We don't control what users do on Himmin and aren't responsible for the consequences of their actions, online or offline. We're also not responsible for third-party services you may access through our Platform. Our liability for anything occurring on Himmin is governed strictly by Indian law and limited accordingly. You agree that we won't be liable for lost profits, revenue, information, or data, or for consequential, special, indirect, exemplary, punitive, or incidental damages — even if we were aware such damages were possible. This includes cases where we delete your content, information, or account.

As an intermediary under Indian law, we don't control what users post, but we expect everyone to follow our Content and Community Guidelines.

g. You Will Not Attempt to Disrupt or Compromise Himmin's Services

Himmin is a community-driven platform, and we ask that you don't interfere with or access non-public parts of our systems, Services, or technical infrastructure. Don't introduce trojans, viruses, malware, bots, or scrapers to extract user information. Don't probe, scan, or test the vulnerability of our systems, security, or authentication measures. If you attempt to tamper with our technical architecture, we'll terminate your account, ban you from the Platform, and may report the matter to law enforcement and pursue legal action.

Hacking or introducing malicious software onto Himmin in any form may result in your removal from the Platform and being reported to the police or relevant authorities.

Permissions You Give to Us

By accepting these Terms, you also grant us certain permissions so we can serve you better:

a. Permission to Share Your Profile Information With Third Parties

Himmin is free to access and use, and to keep it that way, we need to generate revenue. As part of this, we may share data we collect — such as your username, profile picture, and usage/engagement patterns — to show you sponsored content or advertisements. We won't owe you any revenue share if you purchase a product advertised to you, and we don't endorse or vouch for the authenticity of any advertised products. A product being advertised on Himmin doesn't mean we've endorsed it.

If we ever need to share sensitive personal information (as defined under applicable law), we'll ask for your consent first.

b. Automatic Downloads and Updates

We're constantly improving Himmin. To use the Platform, you'll need to download the app and keep it updated. Since we regularly release new versions, you'll need to install the latest update each time one is available in order to continue using our Services smoothly.

c. Permission to Use Cookies

We may use cookies, pixel tags, web beacons, device IDs, and similar technologies to collect and store information about your use of Himmin and related third-party sites.

d. Data Retention

We retain certain information about your usage of the Platform. For details on how we collect, process, store, and use this information, please refer to our Privacy Policy.

By using Himmin, you grant us the right to process, store, and retain information related to you and provided by you — see our Privacy Policy for full details.

Reporting

As a responsible user, please flag or report any video or comment that violates applicable law, our Community Guidelines, or these Terms. This helps keep Himmin safe for everyone. You can use the in-app reporting mechanism to report abusive or offensive content, or reach us via email at arjun@himmin.in.

We may temporarily store reported content for a limited period to comply with applicable regulations and investigate incidents, after which it may be deleted — unless we're required to retain it longer to cooperate with legal authorities.

Our Agreement and What Happens If We Disagree

a. Who Has Rights Under These Terms

The rights and obligations under these Terms belong only to you and can't be assigned to a third party without our consent. We, however, may assign our rights and obligations — for instance, in the event of a merger or restructuring.

b. How We Handle Disputes

Any disputes arising under these Terms will be governed by Indian law, with the courts of Bengaluru having exclusive jurisdiction.

Grievance Redressal Mechanism

We're committed to the privacy and safety of our users and work to keep the Platform safe in line with applicable regulations. We've appointed a Grievance Officer who can be reached directly for any concerns about your experience on Himmin, along with a Grievance Redressal Mechanism to help resolve complaints.

Here's how you can raise a concern:

Report a user profile or piece of content that violates our Community Guidelines using the in-app reporting options (tap the three dots next to a profile, or the report icon on a video/comment).
If a complaint has been raised against you or your content, you can view details and submit an appeal via Profile Settings.
You can also email us directly at arjun@himmin.in with your concern or complaint.
You'll receive an auto-generated ticket number, and we'll act on your complaint in line with our policies and applicable regulations.

Limitation of Liability

We aren't liable for any loss or damage arising directly or indirectly from inaccurate or incomplete information, or from a breach of warranty caused by the actions of another user on the Platform.

Himmin and its Services are provided on an "as is" and "as available" basis, without any express or implied warranties unless stated otherwise in writing. We don't guarantee uninterrupted, timely, secure, or error-free operation, compatibility with every device, or that all errors will be corrected.

Neither we, our affiliates, successors, or assigns — nor our investors, directors, officers, employees, agents, or service providers — will be liable for any special, incidental, punitive, direct, indirect, or consequential damages arising from a breach of these Terms by another user, or from your use of or reliance on the Platform or Services.

If any exclusion in this section is found invalid, and we or our affiliates, officers, or employees become liable for a loss, our total liability will be limited to the amount, if any, you paid us for use of the Platform or Services in the month preceding your claim.

Indemnification

You agree to indemnify, defend, and hold harmless Himmin, our subsidiaries, affiliates, agents, and their respective officers, directors, employees, successors, and assigns from any claim, loss, damage, liability, cost, or expense (including reasonable attorney's fees) arising from:

your access to or use of the Platform and Services;
any breach of your obligations under these Terms;
your violation of any third party's rights, including intellectual property, privacy, or consumer protection rights;
any violation of law or contractual obligation, and related claims or notices;
your negligence or willful misconduct.

This obligation survives termination of these Terms.

Unsolicited Material

We welcome feedback and suggestions. We may use them freely, without any obligation to compensate you or keep them confidential.

Suspension or Termination for Non-Payment

We reserve the right to suspend, restrict, or terminate your access to our Services — in whole or in part, including specific features — at our discretion, with or without notice, if applicable subscription fees go unpaid or a payment fails to process due to expiration, insufficient funds, or unavailable payment methods.

General

If any part of these Terms is found unenforceable, the remaining provisions will continue to apply.
Any amendment or waiver of these Terms must be made in writing and signed by us.
If we don't enforce a particular right under these Terms — including reporting unlawful conduct to authorities, or suspending your account — that doesn't mean we've waived that right.
We reserve all rights not expressly granted to you under these Terms.
